Amparo

The Amparo proceeding is a constitutional control mechanism aimed at protecting human rights from acts of any authority that violate them.

Historically known as the "writ of guarantees," it remains the highest form of protection against governmental actions that may infringe upon fundamental rights.

Types of Amparo Trials

There are two types of Amparo proceedings Direct Amparo and Indirect Amparo.

Additionally, there is another constitutional defense mechanism known as the Action of Unconstitutionality, which Ling Aretz can assist with, helping authorities and representatives defend certain rights under the Constitution.

Direct Amparo

Direct Amparo is a constitutional control mechanism applicable to final rulings, awards, and resolutions that conclude a trial or proceeding.

Grounds for:

  • Final judgments.
  • Awards.
  • Resolutions that terminate a trial.
  • Resolutions that, without deciding the main issue, bring the trial to an end.

Indirect Amparo applies to acts or omissions by authorities that are not final judgments, awards, or resolutions ending a trial but that directly affect individuals and their rights.

Grounds for:

  • Laws.
  • International treaties.
  • Regulations.
  • Decrees.
  • Acts or omissions by authorities other than judicial, administrative, or labor tribunals.
  • Actions during proceedings causing irreparable harm.
  • Actions outside a trial or after its conclusion.
  • Actions affecting third parties not involved in the trial.
  • Any governmental action threatening life, liberty, rights, property, or possessions.

The Action of Unconstitutionality is a constitutional control mechanism to address potential conflicts between general norms (laws, international treaties, regulations) and the Mexican Constitution.

Eligible Parties for Filing:

  • 33% of members of the Chamber of Deputies.
  • 33% of members of the Senate.
  • The Federal Executive through the Legal Advisor.
  • Registered political parties (for electoral matters).
  • The National Human Rights Commission.
  • State human rights protection bodies.
  • The National Institute for Transparency and Access to Information (INAI).
  • The Attorney General of the Republic.
